Kaizen AI Lab ("Kaizen," "we," "us," or "our"), operated by CVDH LLC, respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit kaizenailab.com (the "Site") or engage our services.
Read this policy carefully. By using the Site, you agree to the collection and use of information in accordance with this policy. If you do not agree, do not use the Site.
1. Information We Collect
1.1 Information You Provide
We collect information you voluntarily provide when you:
- Submit a contact form, book a call, or request a consultation (name, email, company, phone number, message contents)
- Subscribe to communications (email address)
- Engage us for services (business information necessary to perform the engagement)
- Take the AI Compliance Readiness Assessment (ACRA) at acra.kaizenailab.com (responses to assessment questions)
- Communicate with us by email, phone, or other means
1.2 Information Collected Automatically
When you visit the Site, we automatically collect:
- Usage data: Pages visited, time on page, referring URL, browser type, device type, operating system, screen resolution, approximate geographic location (derived from IP address)
- Cookies and similar technologies: See Section 5 below
- Server logs: IP address, request timestamps, request methods, response codes
- Advertising and campaign data: Information about how you reached the Site and how you interact with it, collected through advertising pixels for our own campaign measurement and marketing. See Section 5 below.
1.3 Information from Third Parties
We may receive information about you from:
- Analytics providers (Google Analytics 4, Microsoft Clarity, Ahrefs Analytics)
- Advertising platforms (aggregate campaign performance and audience measurement reporting)
- Calendar booking platform (Cal.com, when you schedule a meeting)
- Public sources (LinkedIn, business directories) for prospect research
2. How We Use Your Information
We use the information we collect to:
- Provide, operate, and maintain the Site and our services
- Respond to inquiries, schedule consultations, and deliver requested information
- Perform engagements and fulfill contractual obligations
- Send transactional communications (engagement deliverables, scheduling, invoices)
- Send marketing communications where permitted (you can opt out at any time)
- Measure the performance of our own advertising campaigns and show Kaizen AI Lab advertisements to people who have visited the Site
- Analyze Site usage to improve content, navigation, and performance
- Detect, prevent, and address technical issues, fraud, or abuse
- Comply with legal obligations and protect our legal rights
3. Legal Basis for Processing (EEA/UK Visitors)
If you are located in the European Economic Area or United Kingdom, our legal bases for processing your personal information include:
- Consent: Where you have given consent (e.g., marketing communications, non-essential cookies)
- Contract: To perform a contract with you or take steps at your request before entering a contract
- Legitimate interests: To operate and improve the Site, prevent fraud, and pursue business development, where these interests do not override your rights
- Legal obligation: To comply with applicable law
4. How We Share Information
We do not sell your personal information. We share information only as described below:
- Service providers: We use third-party vendors to host the Site (Cloudflare), provide analytics (Google, Microsoft, Ahrefs), deliver and measure our advertising (advertising platforms), schedule meetings (Cal.com), and send email (transactional and marketing email providers). These vendors process data on our behalf under written agreements or their applicable platform terms.
- Professional advisors: Attorneys, accountants, and other advisors as necessary.
- Legal compliance: When required by law, subpoena, court order, or to protect our rights, property, or safety, or that of others.
- Business transfers: In connection with a merger, acquisition, financing, or sale of assets, with appropriate confidentiality protections.
- With your consent: For any other purpose disclosed at the time of collection.
5. Cookies and Tracking Technologies
We use cookies and similar technologies for:
- Strictly necessary: Cookies required for the Site to function (e.g., security, session management)
- Analytics: Google Analytics 4 (anonymized IP), Microsoft Clarity (session recordings with masked input fields), Ahrefs Analytics (aggregate traffic data)
- Performance: Cloudflare (edge caching, security)
- Advertising: We use advertising pixels and similar tracking technologies on the Site to measure the performance of our own advertising campaigns and to show Kaizen AI Lab advertisements to people who have visited the Site. These technologies may set cookies or use device identifiers to recognize your browser across sites.
5.1 How We Use Advertising Data
We want to be specific about what we do and do not do with information collected through advertising technologies:
- We use it for our own advertising. We retain this information to market Kaizen AI Lab's own services, to measure which campaigns and channels work, and to reach people who have already shown interest in what we do.
- We do not sell it. We do not sell, rent, trade, or otherwise transfer information collected through advertising technologies to third parties for those third parties' own independent marketing or monetization purposes.
- Advertising platforms act as our vendors. Delivering an advertisement necessarily involves the advertising platform that serves it. Those platforms process data on our behalf so that our ads can be delivered and measured. They are bound by their own terms and the applicable platform data-processing agreements. We do not provide them with data so they can sell it onward.
- You can opt out. See Section 5.2 for the controls available to you.
Advertising platforms may independently collect information under their own privacy policies when their technologies are present on the Site. We encourage you to review the privacy policy and advertising controls of any platform whose services you use.
5.2 Your Advertising Choices
You have several ways to limit advertising tracking:
- Control cookies through your browser settings. Most browsers allow you to refuse cookies or alert you when cookies are being sent.
- Use the advertising and privacy settings offered by the relevant advertising platform.
- Use industry opt-out tools such as the Digital Advertising Alliance and the Network Advertising Initiative.
- Enable any built-in tracking protection offered by your browser or device.
Note that disabling cookies may affect Site functionality.
6. Client Engagement Data
If you engage Kaizen AI Lab for consulting services, additional terms apply to client data:
- Confidentiality: Client data is treated as confidential under our engagement agreement and applicable professional rules.
- No model training: Client data is never used to train AI models. Every Kaizen Colony™ deployment runs in dedicated, isolated environments.
- Data segregation: Client data does not cross client boundaries.
- API agreements: We use enterprise API agreements with AI providers that contractually prohibit training on inputs.
- Credentials: Managed through centralized secret vaults with automated rotation and leak detection.
- Retention and deletion: Specified in the engagement agreement.
7. Data Retention
We retain personal information for as long as necessary to fulfill the purposes outlined in this policy, comply with legal obligations, resolve disputes, and enforce our agreements. When we no longer need information, we delete or anonymize it.
8. Security
We implement reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security. You provide information at your own risk.
9. Your Rights
Depending on your jurisdiction, you may have the following rights regarding your personal information:
- Access: Request a copy of the personal information we hold about you
- Correction: Request correction of inaccurate or incomplete information
- Deletion: Request deletion of your personal information
- Restriction: Request restriction of processing
- Portability: Request a copy of your information in a structured, machine-readable format
- Objection: Object to processing based on legitimate interests or for direct marketing
- Withdraw consent: Withdraw consent at any time where processing is based on consent
- Complaint: Lodge a complaint with a supervisory authority

9.1 California Residents (CCPA/CPRA)
California residents have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to delete personal information, the right to correct inaccurate personal information, the right to opt out of "sale" or "sharing" of personal information, and the right to limit use of sensitive personal information.
We do not sell personal information. We do not exchange personal information for money or other valuable consideration.
The CCPA defines "sharing" broadly to include disclosing personal information for cross-context behavioral advertising, even when no money changes hands. Our use of advertising pixels to show Kaizen AI Lab advertisements to people who have visited the Site may constitute "sharing" under that definition. California residents may opt out of this activity at any time by emailing don@kaizenailab.com or by using the controls described in Section 5.2. We will honor opt-out preference signals, including the Global Privacy Control, where technically supported.
We do not use or disclose sensitive personal information for purposes other than those permitted under the CCPA, and we do not knowingly sell or share the personal information of consumers under 16.
10. Children's Privacy
The Site is not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us and we will delete it.
11. International Data Transfers
Kaizen AI Lab is based in the United States. If you access the Site from outside the United States, your information will be transferred to, stored, and processed in the United States. By using the Site, you consent to this transfer.
12. Third-Party Links
The Site may contain links to third-party websites (e.g., acra.kaizenailab.com, cal.com). We are not responsible for the privacy practices of those sites. Review their privacy policies before providing information.
13. Do Not Track and Opt-Out Preference Signals
Some browsers offer a "Do Not Track" signal. Because no industry standard has been adopted for Do Not Track, we do not currently respond to those signals. We do honor recognized opt-out preference signals, including the Global Privacy Control, where technically supported, as described in Section 9.1.
14. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent change. Material changes will be communicated via the Site or email where practicable. Your continued use of the Site after changes take effect constitutes acceptance of the revised policy.
